On April 8, 2011, five workers were killed when a storage and disposal operation for seized commercial fireworks exploded at the Waikele Self Storage facility in Waipahu, Hawaii. Donaldson Enterprises Inc. (DEI) had been contracted by the U.S. Marshals Service to destroy fireworks seized in a federal investigation. The explosion destroyed the storage unit and killed all five DEI employees present at the site.
DEI had no prior experience in fireworks storage or disposal. The company had been awarded the contract to dispose of the seized fireworks despite holding no relevant certifications, training, or experience with energetic materials. On the day of the explosion, workers were moving fireworks from one storage unit to another when a metal-to-metal contact or similar mechanical action likely caused a spark that initiated the explosion of the energetic materials in the storage unit.
The CSB found that DEI was entirely unqualified to perform fireworks disposal work, yet was awarded a federal contract to do so with no verification of competency. Neither federal agencies overseeing the contract nor local regulatory authorities had inspected or assessed DEI competency before work began. No federal regulatory agency had jurisdiction over the safe performance of seized fireworks disposal operations. The case represents a complete regulatory and qualification failure at every level.
